SpotHero Prepaid Credit Terms and Conditions
These SpotHero Prepaid Credit Terms and Conditions (“Prepaid Credit Terms”) constitute a legally binding agreement between you and SpotHero, Inc. (“SpotHero”) governing your purchase and use of SpotHero prepaid credit (“Prepaid Credit”) which is also referred to as Spot Savings.
By purchasing or otherwise using Prepaid Credit, you expressly acknowledge that you understand and agree to these Prepaid Credit Terms and the SpotHero Terms of Use, including its dispute resolution and mandatory arbitration provisions. IF YOU DO NOT AGREE TO THE PREPAID CREDIT TERMS AND SPOTHERO TERMS OF USE (INCLUDING ITS DISPUTE RESOLUTION AND MANDATORY ARBITRATION PROVISIONS), THEN DO NOT PURCHASE OR OTHERWISE USE PREPAID CREDIT.
Prepaid Credit can only be purchased using United States dollars (“USD”) or Canadian dollars ("CAD") and can only be purchased or used in the United States or Canada. Prepaid Credit purchased with USD may only be used in the United States and Prepaid Credit purchased with CAD may only be used in Canada. Prepaid Credit may be subject to certain limits, including total balance limits and transaction limits, as determined by SpotHero in its sole discretion. You must have a SpotHero account in good standing in order to purchase or use Prepaid Credit. Prepaid Credit that has been purchased for, or activated in, a SpotHero account can only be used in that SpotHero Account. No portion of Prepaid Credit may be transferred to another party. Partial redemptions of Prepaid Credit are allocated first against the paid component and then against the promotional component. When you have any Prepaid Credit in your SpotHero account, that Prepaid Credit will be used first to pay for any transactions.
You may also have the option to purchase Prepaid Credit automatically when your account balance falls below a defined threshold (“Auto Reload”). For example, if you set Auto Reload to add $75 to your account balance when it falls below $20, your payment method will be charged $75 and $75 will be added to your account balance each time it falls below $20. From time to time, SpotHero may offer you the ability to receive promotional credit for enabling Auto Reload. Such promotional offers are offered solely in SpotHero’s discretion and are subject to the terms and conditions set forth in these Prepaid Credit Terms as well as the language of the promotional offer.
You may cancel Auto-Refill by signing into your SpotHero account and turning off Auto-Refill before the next scheduled refill has occurred. You may also contact support@spothero.com for assistance in turning off Auto-Refill. Once the refill has occurred, the transaction cannot be reversed. We reserve the right, in our sole discretion, to pause, disable, or discontinue Auto-Refill. This may occur if there is fraud, misconduct, illegal behavior, inactivity, maintenance, a change in law, a need for verifying information, a problem with the payment method on file (such as expiration or insufficient funds), or if the functionality is no longer offered, your account balance reaches a limit set by law or regulation, or for other reasons.
SpotHero allows you to purchase Prepaid Credit to use for qualified parking with subsidized or pre-tax funds as allowed by Section 132 of the Internal Revenue Code. Your participation in your employer's commuter benefit program and your use of commuter benefit program dollars is subject to certain laws, rules, and regulations including Section 132 of the Internal Revenue Code (32 U.S.C. § 132). SpotHero disclaims any and all liability for the failure of you or your employer to follow any and all laws, rules or regulations that govern your commuter benefit program dollars and/or your employer's commuter benefit program. Prepaid Credit purchased through a commuter benefit program may only be used to pay for qualified parking near your work or place of commute for work-related and non-residential purposes.
The amount you paid for Prepaid Credit does not expire, to the extent permitted by applicable law. Any added value with your purchase of Prepaid Credit is a promotion and will expire one year after purchase, unless a different timeline is detailed in any applicable offer made to you. The expiration date/time will be based on Central Time. Except to the extent required by law, Prepaid Credit is not refundable, and is not redeemable for cash. All Prepaid Credit purchases are final. Prepaid Credit has no value until used.
If you choose to delete your SpotHero account, you must spend your Prepaid Credit balance prior to deleting your account. You can check for any Prepaid Credit balance by logging into your account or by contacting SpotHero’s Customer Hero team by email at support@spothero.com or by phone at 844-977-3340. Deletion of your SpotHero account will result in the irrevocable loss of any Prepaid Credit balance remaining at the time of deletion.
SpotHero reserves the right to modify these Prepaid Credit Terms at any time, with or without notice. Your purchase or use of Prepaid Credit following any update to the Prepaid Credit Terms constitutes your acceptance of those terms. SpotHero shall have the ability to redeem any Prepaid Credit balances for cash or move such balance to a successor product, if any, in the event that SpotHero terminates or modifies the existing Prepaid Credit program, to the extent permitted under applicable law.
SpotHero is not responsible for any loss, or unauthorized or fraudulent use of your Prepaid Credit. SpotHero is not responsible if you are unable to access your Prepaid Credit, SpotHero account, or the SpotHero App. You agree that you will not be able to access your Prepaid Credit if your account is involved in a payment dispute, or if your account is suspended or terminated for violating SpotHero’s Terms of Use. SpotHero reserves the right to suspend, withhold, or deduct any portion of your Prepaid Credit balance at any time if SpotHero determines or suspects that your Prepaid Credit was purchased, used, or obtained in error, fraudulently, illegally, in violation of any applicable promotion or program terms, or in violation of these Prepaid Credit Terms.
Prepaid Credit is issued in the State of Illinois and these Prepaid Credit Terms shall be governed by the laws of the State of Illinois without regard to choice of law principles.
